PUBLIC NOTICE LEGAL NOTICE OF HISTORIC EFFECT AND SECTION 4(F) DETERMINATION Howard Avenue and Market Street; Town of Rockville, Adams Township, Parke County, Indiana; Des. No. 1400795, DHPA No. 17891 The Town of Rockville is developing a project for reconstruction of a section of Howard Avenue and Market Street in Rockville, Parke County, Indiana. The project is funded, in part, by the Federal Highway Administration (FHWA). The reconstruction of Howard Avenue and Market Street will repair deteriorating pavement, and involves 3,305-feet of road reconstruction from US 41 to US 36. The typical section includes curb-and-gutter, 6-foot sidewalks on both sides of the road, a 6-foot buffer between curb-and-gutter and sidewalk, new full depth pavement, and 5-foot bike lanes. The project also includes decorative lighting, a new storm sewer system, water main replacement, sanitary sewer replacement, Americans with Disabilities (ADA) compliant curb ramps, the improvement of seven intersections and one alley, and new signs and pavement markings. The Area of Potential Effects (APE) for this undertaking incorporates the project area and includes adjacent properties, as recommended by the Indiana Department of Transportation's (INDOT) Cultural Resources Manual. The APE for archaeological resources is defined as the project footprint. Historians concluded that portions of the project are located within the Rockville Historic District (NR-1128, listed 1993). INDOT, on behalf of the FHWA, issued a "No Adverse Effect" finding for this project on March 22, 2016. In accordance with the National Historic Preservation Act, the views of the public are being sought regarding the effect of the proposed project on the historic elements as per 36 CFR 800.2(d), 800.3(e) and 800.6(a)(4). Pursuant to 36 CFR 800.6(a)(4), the documentation specified in 36 CFR 800.11(e) is available for inspection at American Structurepoint (7260 Shadeland Station, Indianapolis, Indiana, 46256). This documentation serves as the basis for the FHWA's "No Adverse Effect" finding. The views of the public on this finding are being sought. Please reply to the contact listed below. This undertaking will convert property from the Rockville Historic District, a section 4(f) historic property, to a transportation use; INDOT, acting on the behalf of FHWA, has determined the appropriate Section 106 finding is "No Adverse Effect"; therefore, FHWA hereby intends to issue a "de minimis" finding for the Rockville Historic District, pursuant to SAFETEA-LU, thereby satisfying the FHWA's responsibility under Section 4(f) for this historic property.
