Dustin Smith, has filed in the office of the Clerk of the Vigo Superior Court #3 its Complaint against Defendant Unknown heirs devisees, legatees, beneficiaries of Peggy Osmon AKA Peggy L. Osmon and their unknown creditors; and, the unknown executor, administrator, or personal representative of the Estate of Peggy Osmon AKA Peggy L. Osmon, and the said Plaintiff having also filed in said Clerk's office the affidavit of a competent person showing that the residence and whereabouts of the Defendant, Unknown heirs devisees, legatees, beneficiaries of Peggy Osmon AKA Peggy L. Osmon, upon diligent inquiry is unknown, and that said cause of action is for default on the promissory note and to foreclose a mortgage on the following described real estate in Vigo County, State of Indiana, to wit: Lot Number Eight (8) and Nine (9) of Hollywood Subdivision, being a subdivision of Lots 4, 5, 6 and 7 of the Partition of the Phillip's Estates as shown in plat of said Estate recorded in Plat Book 12, Page 37 of the Recorder's Office of Vigo County, Indiana in Section Thirty-five (35) and Thirty-six (36), Township Thirteen (13) North, Range Nine (9) West. Also, the West One-half of alley lying East of said lots as shown vacated in Road Record 8 Page 35 in the records in the Vigo County, Auditor's Office. commonly known as 4563 North Lafayette Street, Terre Haute, IN 47805. NOW, THEREFORE, said Defendant is hereby notified of the filing and pendency of said Complaint against them and that unless they appear and answer or otherwise defend thereto within thirty (30) days after the last notice of this action is published, judgment by default may be entered against said Defendant for the relief demanded in the Complaint.
