STATE OF INDIANA COUNTY OF VIGO IN VIGO SUPERIOR COURT #3 CAUSE NO. 84D03-1603-MF-001823 Wilmington Trust Company as successor to The Bank of New York as successor to JPMorgan Chase Bank, National Association, as Successor Trustee for C-BASS Mortgage Loan Asset-Backed Certificates, Series 2005-CB4 Plaintiff, vs. Caroline M. Jones, et al. Defendants. NOTICE OF SUIT SUMMONS BY PUBLICATION TO: Unknown heirs, devisees, legatees, beneficiaries of Caroline M. Jones and their unknown creditors; and, the unknown executor, administrator, or personal representative of the Estate of Caroline M. Jones: BE IT KNOWN, that Wilmington Trust Company as successor to The Bank of New York as successor to JPMorgan Chase Bank, National Association, as Successor Trustee for C-BASS Mortgage Loan Asset-Backed Certificates, Series 2005-CB4, the above-named Plaintiff, by its attorney, J. Dustin Smith, has filed in the office of the Clerk of the Vigo Superior Court #3 its Complaint against Defendant Unknown heirs, devisees, legatees, beneficiaries of Caroline M. Jones and their unknown creditors; and, the unknown executor, administrator, or personal representative of the Estate of Caroline M. Jones, and the said Plaintiff having also filed in said Clerk's office the affidavit of a competent person showing that the residence and whereabouts of the Defendant, Unknown heirs, devisees, legatees, beneficiaries of Caroline M. Jones and their unknown creditors; and, the unknown executor, administrator, or personal representative of the Estate of Caroline M. Jones, upon diligent inquiry is unknown, and that said cause of action is for default on the promissory note and to foreclose a mortgage on the following described real estate in Vigo County, State of Indiana, to wit: Part of Lot Number Two (2) in George Glick's Subdivision of part of the North East Quarter of Section Thirty-five (35), Township Twelve (12) North of Range Nine (9) West, and part of the North West Quarter (NW 1/4) of Section Thirty-six (36), Township Twelve (12) North, Range Nine (9) West, Vigo County, Indiana, said subdivision being a replat of Lots Four (4) to Twenty (20) inclusive of Division of Wallace Farm, and more particularly described as follows: Commencing at a point 148.4 feet East and 60 feet South of the North West corner of said Lot Number Two (2), thence East parallel with the north line of said Lot Number Two (2), a distance of 162.5 feet; thence South 88 feet; thence West parallel with the north line of said Lot Number Two (2), a distance of 162.5 feet; thence North 88 feet to the place of beginning, except 25 feet off the East end thereof, thence same being the West half of 26th Street, if extended from the North; also except 7.5 feet off the West end thereof same being the East half of an alley if extended from the North. commonly known as 1923 South 26th Street, Terre Haute, IN 47803. NOW, THEREFORE, said Defendant is hereby notified of the filing and pendency of said Complaint against them and that unless they appear and answer or otherwise defend thereto within thirty (30) days after the last notice of this action is published, judgment by default may be entered against said Defendant for the relief demanded in the Complaint.
