NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS March 23, 2016 Housing Authority of the City of Terre Haute PO Box 3086 Terre Haute, IN 47803 812-232-1381 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Housing Authority of the City of Terre Haute. REQUEST FOR RELEASE OF FUNDS On or about April 14, 2016 the Housing Authority of the City of Terre Haute will "authorize the Office of Public and Indian Housing to" submit a request to the HUD/Indianapolis Field Office for the release of Capital Fund Program funds under United States Housing Act of 1937, including the Capital Fund Program statutory requirements (Section 9 of the United States Housing Act of 1937, as amended), and the Capital Fund regulation effective November 25, 2013, found at 24 CFR Part 905 of the name of the Act of 2016, as amended, to undertake a project known as project title for the purpose of nature/scope of project, estimated funding (include non-HUD funding sources if applicable) and project location if applicable. FINDING OF NO SIGNIFICANT IMPACT The Housing Authority of the City of Terre Haute has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Housing Authority of the City of Terre Haute, 2001 N. 19th Street, Terre Haute, IN 47803 and may be examined or copied weekdays _8_A.M to _4:30_P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the Housing Authority of the City of Terre Haute. All comments received by if notice is published: publication date plus fifteen days; if notice is mailed and posted: mailing and posting date plus eighteen days will be considered by the Housing Authority of the City of Terre Haute prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION The Housing Authority of the City of Terre Haute certifies to HUD/Indianapolis Field Office that Jeff Stewart in his capacity as Executive Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's Indianapolis Field Office approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Housing Authority of the City of Terre Haute to use Program funds. OBJECTIONS TO RELEASE OF FUNDS HUD/Indianapolis Field Office will accept objections to its release of fund and the Housing Authority of the City of Terre Haute certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Housing Authority of the City of Terre Haute; (b) the Housing Authority of the City of Terre Haute has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/Indianapolis Field Office; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to U.S. Department of Housing and Urban Development, Office of Public and Indian Housing, at Minton-Capehart Federal Building 575 North Pennsylvania Street, Room 655, Indianapolis, IN 46204-1555.
